Terms of Service

These terms govern use of Sendly, operated by TechShu Digital Private Limited. By creating an account you agree to them. If you are agreeing on behalf of a company, you confirm you are authorised to bind it.
What Sendly is
Sendly is software that lets a business manage WhatsApp conversations with its own customers — a shared inbox, contact management, message templates and broadcasts — built on the WhatsApp Business Platform.
Sendly is not affiliated with, endorsed by, or sponsored by WhatsApp LLC or Meta Platforms, Inc. Message delivery is performed by Meta, not by us.
Your WhatsApp Business Account
You connect your own WhatsApp Business Account. You remain responsible for it, for the phone number registered to it, and for complying with the WhatsApp Business Messaging Policy and Meta’s Commerce Policy. Meta may suspend or ban your number for violations. We cannot reverse that.
Charges for messages are billed by Meta directly to your WhatsApp Business Account. Sendly’s fees, where applicable, are separate and cover the software only.
Acceptable use
You must not use Sendly to:
- Send messages to people who have not opted in to hear from you.
- Send spam, bulk unsolicited marketing, or anything unlawful.
- Impersonate another person or business, or misrepresent who is sending the message.
- Harass, threaten, defraud or deceive recipients.
- Distribute malware, or attempt to breach, overload or reverse engineer the service.
- Resell or sublicense access without a written agreement with us.
Honour opt-out requests promptly. Under the WhatsApp Business Messaging Policy this is your obligation, and repeated failures put your number at risk.
Your data
You own the contacts, messages and other content in your account. You grant us only the licence needed to operate the service on your behalf. Our handling of that data is described in our Privacy Policy.
You are responsible for having a lawful basis to message the people you message, and for the accuracy of the contact data you upload.
Account security
Keep your credentials confidential and tell us promptly if you suspect unauthorised access. You are responsible for activity under your account.
Availability
We aim to keep Sendly running but do not guarantee uninterrupted service. Maintenance, third-party outages and changes to the WhatsApp Business Platform can all cause downtime. Unless a separate written agreement says otherwise, Sendly is provided “as is”, without warranties of any kind.
Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental or consequential losses, including lost profits, lost business or lost data. Our total liability in any twelve-month period is limited to the fees you paid us in that period.
Suspension and termination
You may close your account at any time. We may suspend or terminate an account that breaches these terms, puts the platform at risk, or violates Meta’s policies. On termination you may export your data for 30 days, after which it is deleted per our retention policy.
Changes
We may update these terms. Material changes will be notified to account holders in advance. Continuing to use Sendly after a change means you accept it.
Governing law
These terms are governed by the laws of India. The courts of Kolkata, West Bengal have exclusive jurisdiction over any dispute.
